When it runs
First Tuesday of the month at 10:00 a.m. on the Presidio County Courthouse grounds in Marfa, the statutory Texas sale day. The county's 2026 Notice of Sheriff's Sale reads: "I will proceed to sell at 10:00 a.m. on the 5th day of May, 2026 at the South Door of the Presidio County Courthouse, in Marfa, Texas." The 2025 notice set "10:00 a.m. on the 1st day of April, 2025 at the South entrance of the Courthouse lawn at the Presidio County Courthouse, in Marfa, Texas." Presidio County publishes no fixed annual tax sale calendar; sales are posted as needed. Notices on the county's public notices page are dated December 5, 2023, May 7, 2024, December 3, 2024, April 1, 2025 and May 5, 2026, each one a first Tuesday.
Registration and deposit

No online or advance bidder registration. Bidding happens in person at the courthouse. The Notice of Sheriff's Sale states in capitals: "ALL BIDDERS MUST NOW DISPLAY PROOF OF COMPLIANCE WITH SECTION 34.015 OF THE TEXAS PROPERTY TAX CODE," meaning each bidder must present the written statement from the county assessor-collector showing no delinquent taxes are owed. Request that statement in advance from the Presidio County Tax Assessor-Collector, Presidio County Courthouse 1st Floor, 300 N. Highland Avenue, Marfa, phone (432) 729-4081. The county's Notice of Seizure directs bidding and payment questions to the county's delinquent tax counsel: Mollie Lerew, Perdue Brandon Fielder Collins & Mott LLP, 2500 N. Sale format and venue
Presidio County runs its tax sale in person on the courthouse grounds in Marfa, with no online auction platform on any official county source. A Presidio query against the Linebarger sale feed at taxsales.lgbs.com returns zero records, and Presidio does not appear on the MVBA upcoming sale list. Instead of a dedicated tax sale page, the county posts each Notice of Sheriff's Sale as a PDF on its Current Public Notices page. The 2026 sale ran on tax warrants issued out of the 394th District Court (Cause 5339-A, City of Presidio et al, and Cause 5340-A, Presidio County et al) rather than a conventional judgment docket. Inventory is heavily rural: quarter sections out of T&P and D&P Ry. Co. surveys plus town lots in Presidio and Marfa, many sold as surface interest only with minerals reserved. Perdue Brandon Fielder Collins & Mott LLP (Midland office) serves as the county's delinquent tax counsel and signs the Notice of Seizure. Tracts that do not sell are struck off to the taxing units in trust and resold by sealed bid through Texas Communities Group at texascg.com, minimum bid $50.00 plus fees, payment by cashier's check or money order within two weeks, every bid subject to approval by all taxing units and up to three months for deed approval. Over-the-counter (leftover) purchases

Texas has no over-the-counter certificate list. Parcels that draw no sufficient bid are struck off to the taxing unit that requested the order of sale, and that unit may resell them at any time by public or private sale. A public resale requested through the sheriff or constable may be sold for any amount. A private sale generally may not go below the lesser of the market value stated in the judgment or the total judgments against the property, unless every taxing unit entitled to proceeds consents.   • Bidders buy a redeemable deed. Texas Tax Code section 34.21 gives the former owner two years to redeem homestead, agricultural-use and mineral property at a 25 percent premium in year one and 50 percent in year two, and 180 days at 25 percent for other property. Many Presidio County tracts sell as surface interest only with minerals reserved, so read each tract description in the notice before bidding.

Texas rules

Redemption
The redemption clock runs from the date the purchaser's deed is filed for record, not from the sale date. Property that was the owner's residence homestead or was land designated for agricultural use when the suit or the warrant application was filed, and any mineral interest, may be redeemed on or before the second anniversary of that filing. Every other property may be redeemed only through the 180th day after the deed is filed. When a parcel is struck off to a taxing unit instead, the period runs from the date the taxing unit's deed is filed for record. The former owner has no right to use, possess, or collect rent from the property while the redemption right runs, and the right of redemption cannot be sold or transferred: any instrument purporting to transfer it is void.
Deed deposit
The Tax Code sets no statewide deposit and no buyer premium. Section 34.01 directs the officer to conduct the sale the way similar property is sold under execution, so payment terms are set locally by the officer who runs the sale. Most Texas counties collect the full bid in cash or by cashier's check on the day of the sale. Confirm the terms with the county before you bid.
Homestead deeds
Texas sets no separate opening bid for a homestead. What changes on a homestead parcel is the exit: a residence homestead, land designated for agricultural use when the suit or warrant application was filed, and a mineral interest all carry a two-year redemption right instead of 180 days, and the premium the owner pays can reach 50 percent in the second year. Price a homestead parcel for that longer clock.
Surplus proceeds
The officer pays any excess proceeds to the clerk of the court that issued the order of sale. The clerk holds the excess for two years after the sale and notifies the former owner when the amount exceeds $25. A claim must be filed before the second anniversary of the sale. The court pays established claims in statutory priority: a purchaser at a sale later adjudged void, taxing units for post-judgment or omitted taxes, other lienholders, taxing units for unsatisfied judgment amounts, and then the former owner. Anything unclaimed is distributed to the taxing units.
