How Stephens County sells delinquent taxes

No tax lien certificate sale

Georgia counties sell the property under a tax execution rather than auctioning tax lien certificates.

When it runs
No sale calendar is published. The Tax Commissioner's "Tax Sales" page exists but carries no sale date, no property list and no auction platform, and the April 17, 2026 archive capture of the same page is equally blank. Georgia levy sales run on the first Tuesday of the month at the courthouse. Stephens County's excess funds worksheet, revised 6/15/26, records tax sale bids for tax years 2021 through 2025, so sales do happen on a recurring basis, but the office does not post the next date online. Call (706) 886-4753 and ask for the Property/Delinquent Tax Supervisor to confirm the next sale.
Registration and deposit

Nothing is published online. The Tax Commissioner's office posts no bidder registration form, no deposit requirement and no bidder packet, and there is no online bidding portal to open an account on. Contact the office at (706) 886-4753 before the sale to confirm the identification and form of payment the ex-officio sheriff will require at the courthouse.

Sale format and venue
Stephens County sells a redeemable tax deed and the sale is conducted in person, not online. The county's own FAQ states that if property taxes remain unpaid "the tax commissioner has the right and responsibility to levy on the property for non-payment," and the general information page states that if taxes are not collected the property "may be levied upon and ultimately sold." No online auction platform is listed on any county page, so no platform or platform URL is given here. A Bid4Assets listing for Stephens County describes the sale as a "Live Tax Redeemable Deed Sale" with sale type "Live/In Person," but Bid4Assets states on that same page that it "is not conducting this public auction" and that the information came from a third party and "has not been verified," so treat it as a pointer only and not as the auction site. The county's legal organ, The Toccoa Record, carried no tax sale notice in its July 23, 2026 legals, only a civil sheriff's sale set for "the first Tuesday in September, being September 1, 2026" at the courthouse. Buyers take a redeemable deed subject to the 12 month right of redemption under O.C.G.A. 48-4-40 et seq.

Work out what the parcel is actually worth with the rural land value estimator, then turn it into a ceiling with the tax deed max-bid calculator.

Georgia rules

Redemption
The right to redeem runs for 12 months from the date of the sale and does not end there. It continues after the year until the tax deed purchaser forecloses it by serving and publishing the statutory barment notice, which cannot be started until 12 months have passed. The purchaser delivers the notice to the sheriff at least 45 days before the redemption deadline named in it, and publishes it once a week for four consecutive weeks in the six months immediately before that deadline. Redemption puts title back in the defendant in fi. fa. subject to the liens that existed at the sale, and the purchaser must execute and record a quitclaim deed. Title under a tax deed recorded on or after July 1, 1996 ripens by prescription four years after recording. Judicial in rem foreclosures under Article 5 run on a different clock: the owner has 60 days after the sale to redeem by paying the minimum bid price into the superior court.
Deed deposit
Georgia sets no statewide percentage deposit. A purchaser at a judicial sale may tender cash or a cashier's or certified check drawn for the purchase price and issued or certified by a federally insured financial institution. Counties publish their own payment terms, and many require payment in full at the close of the sale, so confirm the terms with the tax commissioner before bidding.
Surplus proceeds
Excess funds left after taxes, costs, and the expenses of the sale belong to the former owner and to recorded lienholders in order of priority. The officer who sold the property must mail notice of the excess funds by first-class mail within 30 days to the record owner at the time of the sale, to the holder of each security deed, and to every other party with a recorded equity interest or claim, and may file an interpleader action in superior court. Funds still unclaimed five years after the sale are paid over to the Georgia Department of Revenue, after which only a court order from an interpleader action releases them.
Governing statute
O.C.G.A. Title 48, Chapter 4

A tax deed does not convey marketable title. Most buyers file a quiet title action before they can resell or insure the property. See the due diligence guide.
