When it runs
Banks County has held its tax sale on the first Tuesday in November. The county's official Excess Funds List records "Sale Date: November 5th, 2024", "Sale Date: November 7th, 2023", "Sale Date: November 2nd, 2021" and "Sale Date: November 3rd, 2020", each of which is the first Tuesday of November. The county does not publish a forward-looking sale calendar, so confirm the current year's date with the Tax Commissioner.
Registration and deposit

Banks County publishes no bidder registration procedure, deposit rule or bidding instructions on its website. Call the Tax Commissioner at 706-677-6204 before the sale to confirm what registration and payment the office requires.

Sale format and venue
Banks County is a small north Georgia county that runs a redeemable tax deed sale under O.C.G.A. Title 48, Chapter 4. The sale is conducted in person; no online auction platform appears in any official Banks County source, and no county page describes an internet sale, so bidding follows the Georgia statutory default of a public outcry sale at the courthouse on the first Tuesday of the month. The county maintains no dedicated tax sale web page: the Tax Commissioner section covers only Property Tax, Tax Services, Resources, Record Search, FAQs and Excess Funds. The only sale-related list the county publishes online is the post-sale Excess Funds List, which names each parcel's winning purchaser and former owner and is therefore the best public record of who buys at these sales. Successful bidders receive a tax deed subject to the 12-month statutory right of redemption at a 20 percent premium.

Banks County tax sale list and auction calendar

For Banks County tax sale 2026 searches, use the county-run sources below rather than a copied parcel list, and confirm the parcel, registration cutoff, deposit, and payment deadline against the county before you bid. If the parcels on this list are vacant land rather than houses, what buying land at a tax sale hands you is the place to start.

  1. Get the advertised list

Use Excess Funds List (post-sale, PDF) for the current advertised parcels, then recheck it before the auction.
  2. Register to bid

Ask the county office how and when to register; many counties close registration days or weeks before the sale.
  3. Sale day

Banks County has held its tax sale on the first Tuesday in November. The sale is live and in person; there is no online bidding platform. Confirm the venue and hour with the county office before you go.
  4. Confirm with the office

If the list, platform, and notice disagree, use Banks County Tax Commissioner as the source to confirm which parcels are actually offered.

Before you bid in Banks County

  1. Start with the live sale list

Pull the current advertised parcels from Excess Funds List (post-sale, PDF). Lists can change before the sale, so recheck the county source before you price a parcel.
  2. Confirm registration and deposit

Banks County publishes no bidder registration procedure, deposit rule or bidding instructions on its website. Call the Tax Commissioner at 706-677-6204 before the sale to confirm what registration and payment the office requires.

  3. Check the state rules that change the bid

Read the Georgia due-diligence checklist before bidding. Redemption, liens that survive a tax deed, title cleanup, and payment deadlines can change what a parcel is worth. Which liens survive is state law, so read what survives a tax deed in Georgia before you price the title work.
  4. Set a walk-away number

Work out what the parcel is actually worth with the rural land value estimator, then turn it into a ceiling with the tax deed max-bid calculator.

Use the arrow keys to switch between these sections.

County notes

  • No dedicated tax sale page exists on the Banks County website. A full sitemap review returned only 5-Year Tax Levy, Property Tax, City Taxes, Timber Tax, Sheriff, Excess Funds and Foreclosure Forms as tax or sale related pages; none describes the delinquent tax sale.
  • Real sale dates were recovered from the county's official Excess Funds List PDF: November 5, 2024, November 7, 2023, November 2, 2021 and November 3, 2020. Every one falls on the first Tuesday in November, a consistent county-level pattern within the Georgia first-Tuesday statutory window.
  • The Excess Funds List records a named winning purchaser and a former owner per parcel, confirming Banks County runs a competitive bid redeemable deed sale rather than a bid-down-interest certificate sale.
  • The Property Tax page states only that the Property Tax Division is responsible for "the levy of property for delinquent taxes". No timing, registration, deposit or bidding detail is published.
  • The Banks County Sheriff's Office page carries no tax sale, levy or sheriff's sale content, consistent with the Tax Commissioner acting as ex-officio sheriff for tax sales.
  • The Georgia Department of Revenue county page for Banks adds no sale specifics; it links back to the county site and confirms the Tax Commissioner as the responsible office.
  • Contacts: Tax Commissioner Becky Carlan, listed at 706-677-6204 Ext. 1117, fax 888-716-6431, bcarlan@co.banks.ga.us. Main county annex line is 706-677-6200. The office sits in the Banks County Annex at 150 Hudson Ridge, Homer.
  • Investors should call the office to obtain the advertised sale list. Georgia requires tax sale advertisement in the county legal organ, but Banks County does not mirror that notice on its website.
  • Confidence note: the November first-Tuesday timing is inferred from four years of actual recorded sale dates in an official county document, not from a county-published sale calendar. Treat it as a strong pattern, not a guaranteed schedule.

Georgia rules

Redemption
The right to redeem runs for 12 months from the date of the sale and does not end there. It continues after the year until the tax deed purchaser forecloses it by serving and publishing the statutory barment notice, which cannot be started until 12 months have passed. The purchaser delivers the notice to the sheriff at least 45 days before the redemption deadline named in it, and publishes it once a week for four consecutive weeks in the six months immediately before that deadline. Redemption puts title back in the defendant in fi. fa. subject to the liens that existed at the sale, and the purchaser must execute and record a quitclaim deed. Title under a tax deed recorded on or after July 1, 1996 ripens by prescription four years after recording. Judicial in rem foreclosures under Article 5 run on a different clock: the owner has 60 days after the sale to redeem by paying the minimum bid price into the superior court.
Deed deposit
Georgia sets no statewide percentage deposit. A purchaser at a judicial sale may tender cash or a cashier's or certified check drawn for the purchase price and issued or certified by a federally insured financial institution. Counties publish their own payment terms, and many require payment in full at the close of the sale, so confirm the terms with the tax commissioner before bidding.
Surplus proceeds
Excess funds left after taxes, costs, and the expenses of the sale belong to the former owner and to recorded lienholders in order of priority. The officer who sold the property must mail notice of the excess funds by first-class mail within 30 days to the record owner at the time of the sale, to the holder of each security deed, and to every other party with a recorded equity interest or claim, and may file an interpleader action in superior court. Funds still unclaimed five years after the sale are paid over to the Georgia Department of Revenue, after which only a court order from an interpleader action releases them.
Governing statute
O.C.G.A. Title 48, Chapter 4

A tax deed does not convey marketable title. Most buyers file a quiet title action before they can resell or insure the property. See the due diligence guide.
